Which is better in a criminal justice system

Everyone knows the criminal justice system isn't perfect, regardless of which country you live in. There are guilty people that get off without any punishment, and innocent people sitting in jail. But the question is, in the case of a judiciary mistake, which is it better to error on:

A.) Convict an innocent person
B.) Let a guilty person go free

And why?

Please Note - We are not talking about crime details here, so don't say "Well if it's something like shop lifting then I'd pick this, but if it's murder then I pick this". That's not the question. The question is, if the court makes a mistake which is the better mistake to make: convict the innocent or reward the guilty.

I would say without the death penalty, the earlier option. With the death penalty, the latter option.

And besides, this argument is becoming obsolete as DNA testing becomes more available. Still, in a country with the death penalty, convicting an innocent person and giving them death is inexcusable.

I think it's better to let a guilty person go free than put an innocent person behind bars.

It doesn't matter if you convict the wrong party or if you let the guilty party go. Either way, the guilty part is still free. So if the guilty party is going to be free either way, then convicting an innocent just adds to the problem.

That's a pretty darn good point if the two were meant to be considered together. I'm not sure if they were. If the two were meant to be considered on their own (so, an innocent person behind bars with no guilty people running around), I'd still stick to my original view.

If there was a crime and someone who wasn't guilty is punished, then that means that the person who is guilty is still free. There can't be a crime without someone that's guilty.

Even if the crime didn't ever happen and the innocent is being put into prison (conspiracy or maybe imprisonment just for existing, perhaps becuse of race, religion, or rank), there is still someone that is guilty of a crime (this time being those that put the innocent in jail, but they'd probably be guilty of a seperate crime and not the one the innocent is being convicted for).

there needs to be enough evidence in the case and if they keep pleading the 5th amendment and doesnt answer any questions (even though techincally they are protected under law) I would want them behind bars but not for life
why?


hell, its one person less to worry about even if he didnt do it (whatever it is)
and no im not cold hearted i just think that people that are suspicious should at least be kept in jail until they are found guilty or non guilty because things like this could take months or years

That is a valid point, but not all crimes are solved with DNA testing; not all crimes can be solved with DNA testing. Besides that, I was talking mainly theoretically.
