Daniel Jacobs (Driver 2) is being issued a summons to appear in court for Reckless Driving.

WHEN: 11/07/2007
9:48 a.m. (arrest time)

WHERE: Nicholas Bollea turned himself in to Clearwater Police at 14450 46th Street North. He is been transported by Clearwater Police to the Pinellas County Jail where he is currently being booked.

HOW/WHY: The Clearwater Police Department has completed an extensive investigation into the causes of an August 26, 2007 wreck involving Nicholas Bollea and his passenger John Graziano III. The investigation, conducted by a team of four (4) specially trained police investigators, working in conjunction with the Pinellas-Pasco State Attorney’s Office, involved the critical examination of substantial physical evidence and the interviews of numerous witnesses. Based on the evidence and witness testimony, investigators have concluded that Bollea was operating his vehicle recklessly at the time of the crash and caused serious bodily injury to Graziano.

This morning a warrant was issued for Bollea’s arrest per Florida Statute 316.192 (3)© 2 (Reckless Driving Involving Serious Bodily Injury). Bollea turned himself in to Clearwater Police. He has been transported and is currently being booked into the Pinellas County Jail. Reckless Driving Involving Serious Bodily Injury is a third-degree felony. Bollea was also cited for:

-Use of a motor vehicle in commission of a felony;

-A person under the age of 21 operating a vehicle with a breathalcohol
level of .02 or higher;

-Illegal window tint

Investigators interviewed several witnesses who stated they saw Bollea (Driver 1) and Daniel Jacobs (Driver 2) racing, before Bollea lost control of the his vehicle and crashed into a tree. The vehicle came to rest in the median of Court Street, east of South Missouri Ave at 7:31 p.m. on August 26, 2007. Investigators have determined Bollea was driving in excess of 60 miles per hour close to or at the time of the crash. The posted speed limit in that area is 40 miles per hour. The road was also wet due to a recent rain shower. Investigators have concluded that although Vehicle 1 and Vehicle 2 were racing, Jacobs (Driver 2) was not a direct cause in the crash. Jacobs is being issued a summons to appear in court for Reckless Driving.

None of the Hogan family attorneys returned calls for comment from the ABC affiliate in Tampa regarding Linda's videotaped comments regarding street racing in 2005. Once again, Linda said, "Oh, I love it. I love it. The rush, the speed on the road, stereo blasting, heart-pounding, racing in between all the cars, dodging the cops. It's awesome." Linda refuted her comments early this week by saying, "I never said that ... I would never have said that." Regarding the suspended license of Nick Hogan, Ann Nucatola, a spokeswoman for the Florida Department of Highway Safety & Motor Vehicles said, "We have the ability to suspend someone's license if we believe what they could be convicted of is a potential danger should this person remain on the road. We've deemed him dangerous to the general public on the road."

According to a report released today by authorities in the Nick Hogan car crash, Hulk Hogan was with his son Nick, John Graziano who was injured, and two other friends of Nick's, Barrett Lawrence and Daniel Jacobs when Hulk purchased 2 cases of Miller Lite, 2 cases of Corona Extra, 1 case of Miller Chill and 5 bags of ice at an Albertson's store in Clearwater, FL.

The group of five then spent time boating before being turned away at a local establishment, Shepard's Tiki Bar, because Nick was underage. A bouncer for Shepard's told authorities that everyone in the group entered the bar holding bottles of Corona, except Nick, who was drinking from a green cup. The decision was then made to go to Arigato's Steakhouse in Clearwater with Nick and John driving the yellow Supra and Daniel and Barrett driving a silver Dodge Viper. Both of cars were owned by Hulk Hogan.

Investigators allege that Nick was racing the Supra against the Viper when he lost control and crashed. Both Jacobs and Lawrence deny racing Nick at the time of the crash. When interviewed by investigators, Lawrence claimed that the Viper he was in, the Supra, a motorcycle and another vehicle were all at an intersection at a red light and when the light turned green, he claims Jacobs cut infront of the motorcycle to pass Nick and when they did, they heard the Supra crash behind them. Lawrence told authorities that the Supra that Nick was driving was at or near 100 miles per hour at the time of the crash.

Nick Hogan is being charged as an adult and faces the following charges: Reckless Driving Involving Serious Bodily Injury, Use of a Motor Vehicle in Commission of a Felony, Being Under the Age of 21 and Operating a Vehicle with a Breath-Alcohol Level of .02 or Higher and Having Illegal Window Tint on a Vehicle.

Hulk Hogan's attorney denied comment when contacted by Tampa Bay Channel 10, saying that he had not seen the official report yet.

The Sarasota Herald Tribune is reporting that Hulk Hogan filed divorce papers Wednesday claiming that his estranged wife Linda can support herself and doesn't need alimony from him. Hulk also stated that she doesn't need child support even though Nick is only 17; he is no longer a student. He said that Nick can choose to live where he wants to and shouldn't be forced to live with Linda.

The mother of John Graziano (Nick's friend who was permanently incapacitated in an accident with Nick this summer) said in a deposition field Wednesday that Nick Bollea told her he crashed the 1998 Toyota Supra after hitting a puddle in the road that he could not avoid. "He said they were driving, and he saw a puddle, and he tried to avoid it, but there was a car next to him that he couldn't get around," Deborah Graziano told prosecutors. "So, they hit the puddle and hydroplaned."

She also said that Hulk Hogan was very upset about the accident and that they boys took the car because he "took too long in the shower" and they got tired of waiting on him. This doesn't match up with an earlier report we had this week that made claims that Hogan was with the boys and bought cases of beer for them before the accident. Photos were also recently released that show Hulk & Nick drinking on supposivly the day of the accident.
