So, a couple of weeks ago I was in a car accident. I was sitting in a parking lot when some lady, talking on her phone and not paying attention, hit me. I drive a Chevy Silverado truck. It dented the bed above the wheel on the back passenger side and knocked my tail light loose. The truck runs fine and the lights still work. Basically it's a lot of cosmetic damage on the back bumper and above the wheel. Today, I got a check in the mail from her insurance company for $2,150.00 as their estimated cost of fixing the damage. Cashing the check means I accept it as settlement of the debt. The letter says that I should take it to my repair shop and if they find more damage the shop can give a new figure and the insurance company will cut a check blah blah blah. My question is this, can I just not fix my truck and keep the money? Is that an option? If it is, would you do it? Advice? |

*IANAL, but you should be okay since it's from her insurance company (and you outright own your car), according to my GoogleFu. If the truck is fine and the cops won't bother you, then I would seriously consider keeping the money. *Don't listen to me |

I am not a lawyer nor do I have any true knowledge of the law, but from my understanding you can accept the settlement and not fix your car, but you cannot file again nor can you blame anyone if you get a ticket for driving a damaged vehicle (which some states won't allow). The settlement is basically their insurance's way of shutting you up, and they want to do it for as little as possible. You accept the agreement and cash the check, they'll shut up. Also, there is a site (i forget the name and am about to leave) where you can ask lawyers free legal advice. You basically post a question and any verified lawyer will give you free advice and recommendations. It could be worth asking just to be safe? |

Basically what I understand is, if I own my truck, which I do, I can basically cash the check from her insurance company and do whatever I want with it. I think there is a risk that if my truck is damaged in the same spot, it won't get paid for. Next time. I'm basically devaluing the truck by $2150 or paying to have it repaired and bringing the value back up by that much I guess. And, as I said, it's just a dent in the side of the bed so I don't have to worry about a ticket or anything. The truck isn't a road hazard. |

If you're 100% sure that the damage is just cosmetic and is not affecting the way it runs at all, and you don't particularly care about the way it looks right now (maybe you can get it fixed later on?), then go for it. |
