Thanks for the clarification -- I was talking about smaller bankruptcies, which of course, this one isn't. Makes sense if they have valuable things that have good resell value, even if they didn't but could be sold, the courts would make them do that. |

Are they even allowed to re-file bankruptcy after being convicted of fraud with that, or whatever it was? I remember reading a Vanity Fair article about Maddox (that was his name I think, the hedge fund guy that stole everyone's money?_) They took EVERYTHING from his widow, including her hats, her purses, her shoes, her house, her clothes, she had to walk out of her apartment with what was on her back, and even with that, they wouldn't let her wear or carry anything that cost more than a couple hundred bucks. |

I just don't understand why they would allow them to keep the shore house because there is no reason why they would need to own 2 homes. Plus, I don't know where that house is in relation to anything else but it would make more sense they'd let them keep the shore house as their family home to live in and sell or take the bigger one. Since she doesn't work a traditional job at an office she really couldn't use her commute as an excuse. Not to mention the expensive vehicles. Tre could be told that she has to sell the expensive SUV's and she's getting a 5 year old Dodge Caravan. |

They don't always make them sell everything, however, you must tell about everything. Such as an engagement ring. They may let you keep it but if you don't claim it and the value it's lying. So if you are married and you say I have no ring you really need to prove it or show an appraisal of its worth. They figure that 99+% of the population or so have an engagement ring. If you don't report it and they find out then it's worse. They may be able to protect some assets just like the cars etc. If you lie it's the worst. They may catch you - not all of course - but they got nailed and for a lot more than that. Don't hide. The trustee will most likely figure it out. If it's a huge asset them may choose to sell it to pay off the creditors. Up to them. Most people get to keep the engagement ring but not necessarily all the jewelry if it's worth a lot of money especially when gold was worth a fortune. For example - Taylor - she had to sell that ring and perhaps her what turned out to be fake Birkins.. The stuff that they owe money on is repossessed. Different category all together. Btw it's everyone's right to file bankruptcy. It can happen to everyone. Just tell the truth. Just think about all those Lehman and BS guys who lost their jobs etc etc - not talking about criminals who seem to not go to jail anyway - jus the regular guys who worked there. I missed that -- did they keep the shore house? Maybe it's more than 50% owned by someone else. They can't force someone else to sell to get the value that Tree and Juicy owe, I think. Again, correct me if I'm wrong. Madoff, Mariah, Bernie Madoff. And with him, it was criminal activity, so everything was forfeit because of how he got it. That wasn't a bankruptcy, but a claim from wronged parties. I don't recall if it was a civil case or criminal that led to that seizure, probably federal with the feds splitting the proceeds according to percentages, which means no one got much. |

Yep there you go! Go search so old Daily Shows. I know it's not real news but he jokes about it and basically explains it banally so we can understand. ARGH! Nobody went to jail but the few you said. They are also permitting all those things that put us there in the first place legal again. They didn't outlaw them. It's unreal to me. It's wonderful for those who work in the business. |

I don't think they have taken anything away from the Giudices because they withdrew the bankruptcy. They may be able to sell off some of those properties if the banks have not already foreclosed and repossessed them - or did the bankruptcy forestall that? I don't know. If they still own the commercial properties/shore house - even without equity and those properties have any value - or value equal to the mortgage, they should sell the properties off and pay off those mortgages. Once they get sentenced, maybe the feds will seize stuff as part of restitution? Is that what happened with Madoff? |

I think it's 2 different things that per probably filed - personal bankruptcy and Juicy's business. Anything that is secured debt and not paid for can be seized. The other things are up in the air since they are unsecured debt. Theresa said over and over she will pay her debts which were unsecured since they were credit cards. She must have been part of the secured debt though and lied. Creating a fake w2 is a huge no no and it wasn't just lying about cash collected. She lied about income on secured loans and mortgages. Very different than saying something like I make $100K a year and getting a credit card even though they may have made $20K. The banks should have checked that so the are co contributers to problem. They faked w2s - not even 1099s ( which are independent contractor tax issues)

Do we know what counts the pled guilty to? I'm wary of saying "they did X" until they have admitted it. That Monica Chason? looked just as law-abiding as Tree & Juicy, that is to say "not at all." |
