That's not a moot question, mort. Of course it doesn't, but, since nobody's taking him to court -- yet -- what difference does it make? When their lawyers send him the letter, and they will, then he will cease and desist like they tell him to, because there's no way he has the stomach to fight a big corporation. A friend's little company owns rights to a 87-year-old silent feature which was announced for release by another smallish company a few years ago. He sent them a letter and they withdrew the picture. But now they have announced it again, for release next month, presumably on the advice of some lawyer. My friend sent them another letter. He's prepared to take them to court if they force him to; otherwise, what point was there in his buying the rights? Their lawyer will make money, which I suppose was the idea, and there will be no release. |

Paramount didn't want to spend 42 cents to send a letter. I can see how much they think serials are worth.

Wouldn’t Lionsgate be the interested party? My gut tells me Grood is pretty safe unless someone decides to make an example of him. There would be some satisfaction in seeing him get nailed, since he has always harped on the copyright issue, and since I find his current dodge laughable. But I guess I should try to be a nicer person. |

Why? I'm certain DVD companies have stock letter #14-B ("Cease & Desist, Pirate") in the file, and just need to add an addressee and run it through the postage machine. Probably takes only a second. |

They undoubtedly have boilerplate to that effect, but any letter like that would have to be vetted by the legal department, and I’ll bet you it wouldn’t go out the door without at least a thousand dollars of non-chargeable time. And the beneficiary would be another company which has already paid license fees. Now, of course, if Lionsgate actually got its act together on its MOD program and discovered that Daredevils was a unique title…(assuming of course it wasn't excluded from their licensed package; hey, let's doublecheck on that and run up some more time!) But on second thought the damned thing would be lucky to sell a hundred copies anyway. That’s why I think Grood is pretty safe, unless there's a management policy somewhere of pursuing any and all copyright infringements.. |

Wellll, I don't think that's quite as clear as some people make it. Obviously, Grood is trying to use the Fair Use provision for his own purposes. Would it fly in court?? Hell, I dunno... but then neither do you. The point is, it would take more than a cease & desist order. BUT, if taken to the limit, Grood would have to back off because he simply wouldn't have the assets to support a case against a large corporation. However, I think Frank Hale probably has the correct slant. The amount of money involved in marketing these products is so minimal (& shrinking all the time), it really isn't worth the company's time & money to fight it. |

Fair use?? FAIR USE??? How the hell is selling the whole damn serial fair use???? Do you even know what the fair use proviso is, mort???? It's certainly NOT selling the whole serial. Again, I have seen sites that have just 2 minute clips from the movie on it be ordered to take it down. And 2 minutes is a whole lot closer to fair use than four and a half hours, mort!Fair Uses of Copyrighted Material Under the Copyright Act, the fair use of copyrighted material without permission is allowed when used for the following purposes: Criticism Comment News reporting Teaching, includes making copies for use in the classroom Scholarship and research Parody These uses do not grant the right to use the copyrighted work in its entirety. Sorry, mort, but selling the whole damn serial is NOT Fair Use, nor can it be used for a "Fair Use" argument. Since you seem unfamiliar with the law, let me quote for you the portion concerning Fair Use:
