Frank, the problem isn't the rhetoric. It's the stinking edit function. Believe me, if I could have formatted my response in the editing, it would seem a lot more coherent. Actually, if Gravy could delete the post above the post I managed to successfully put a quote in (and maybe fix the formatting of that second post), I'd be appreciative.

Mort, remember it is 99% of lawyers that give the rest of the lawyers a bad name. :D
Hey, Pa, didn't you say you had a friend who pointed out that there was no proviso in the copyright laws to allow "orphan" films to be released without proper permission?
Yes, I have a friend who is a retired law professor, and I asked him about orphan film claim, and he said there is no such thing.

Cease and desist isn't as complicated as all that. All you need is a legitimate letterhead and the willingness to say the thing is your property. Who's dumb enough to sue you for doing that?
Life is just a bowl of cherries, it's too mysterious, don't take it serious...

Hello fellas~I'd think that after all this time you'd be tired of the Grood Wars. I certainly am. I think it's a shame that we can't all be a single community again. Why couldn't we just let bygones be bygones and try to be friends again. And after that, I'd like to ask you if you remember rule #2 for posting on these boards? If you can,t, would you please read it again? I'm sorry to have to bring that up, but this thread looks like it's just headed towards restarting the wars. I don't think any of us wants to go through that again, do we?

Sincerely,

willie

Hi Willie. You are correct that it is a shame that we can't all be a community again, and we are way too small a group to be fragmented this way. The fact is that this thread has 125 replies should tell you something about the situation. Take a minute and look on page six for my post of Jan 21st for a couple of examples of why there is this discord. Unfortunately, when Grood is faced with disagreement, his standard reaction is to strike out blindly against the person involved, making the most outlandish and uncalled for accusations against him. Many of us who have experienced his attacks used to consider him to be our friend. As for being friends again, he has banned a couple of dozen people from the Squadron, sometimes for little or no reason. One person who has another serial site visited the Squadron after a couple of years and found out he was banned. He has no idea why.

For what it's worth, generally, you get the cease & desist letter first. Then when you ignore it, you get sued.

The point is, it would take more than a cease & desist order. BUT, if taken to the limit, Grood would have to back off because he simply wouldn't have the assets to support a case against a large corporation.

They would just bleed him......as do many big corporations do with trying to shut something down....It's David vs Goliath.....however David only has one stone......but does not have the strength to throw it hard enough.

I have seen sites that have just 2 minute clips from the movie on it be ordered to take it down.
You tube is a perfect example of it.....and for the most part there is no financial gain for the poster of the clip...when you are selling something it raises a couple of neck hairs.....

copyright is generally black and white.....however in reality to investigate the validity of copyright of certain items can be a lengthy and costly endeavor...the average joe cannot spend that much time nor assets to come to a conclusion.. there have been some weird instances where certain desist letters are floating in a rather gray fog.

back in the 90's I believe Wade Williams (?) added new new space footage I believe to the film Mission to mars (I believe if my memory does not fail me is the film in question) and stated that his "special Edition" was copyrighted...

I have personally known people that have been contacted by Kit Parker as well regarding certain films that were part of the package dealt to VCI....

back in the early 80's I owned a copy of the Silent Peter Pan on 16mm (a dupe) however in the mid nineties I transferred it to video and sold copies.....I was not contacted by any major studio however by Kino video...about it...

as I stated earlier although pretty straight forward there is still a great deal of Machiavellian intrigue going on.

alas who is to blame or not to blame.....that is the question

And that's pretty much the point I was trying to make.... before the dump truck arrived & deposited its supply of contumely (thanks to the Bard of Avon for one of my favorite words) on my dome.

Willie, for the most part, I ignore these threads against Eric. I simply don't have much interest or much time. But it seems you're asking me to "forgive and forget" a man who stole money from me. Let him give the money back and I'll consider it.

Willie, as I have told you in the past, I am under no obligation to forgive anyone who has trashed me and my friends and not even attempted to apologize and indeed, continues his trash talking ways. Guess you think I didn't see the thread referencing SerialFest 2012 (which won't happen, btw). I am further under no obligation to forgive someone who has ripped off a number of my friends. I know at least two people who contributed to THE MASKED RIDER who have died withou receiving the final product. You may think that's okay since he pirated DDOTW, but it really isn't.

Mort, if you don't want an answer, don't ask a question. Just because several of us have informed you of the illegality of Grood's recent move, doesn't mean that a pile of dung was dropped on your head.

Thank you so much.

Willie, perhaps you should help us mend our ways by posting more often and setting a positive example.
