Life is not getting better for Mike Vick.

Michael Vick, already looking at a federal prison term for bankrolling a dogfighting operation in rural Virginia, now faces two state charges that could get him more prison time if he's convicted.

After a Surry County grand jury indicted the Atlanta Falcons quarterback and three co-defendants Tuesday, Vick's lawyers indicated they will fight the state charges on the grounds that he can't be convicted twice of the same crime.

The NFL star, scheduled for sentencing Dec. 10 after pleading guilty to federal dogfighting conspiracy charges, faces state charges of beating or killing or causing dogs to fight other dogs and engaging in or promoting dogfighting. Each felony is punishable by up to five years in prison. Arraignments are set for Oct. 3.

The grand jury declined to indict the 27-year-old Vick and two co-defendants on eight additional counts of killing or causing to be killed a companion animal, felonies that would have exposed them to as many as 40 years in prison if convicted.

Vick sentenced to 23 months in federal prison

The suspended Atlanta Falcons quarterback could have been sentenced up to five years by District Judge Henry E. Hudson. Vick was dressed in a black-and-white striped prison suit and apologized to the court and his family.

Vick pleaded guilty in August, admitting he bankrolled the "Bad Newz Kennels" dogfighting operation and helped kill six to eight dogs.

In a plea agreement, he admitted bankrolling the dogfighting ring on his 15-acre property in rural southeastern Virginia and helping kill pit bulls that did not perform well in test fights. He also admitted providing money for bets on the fights but said he never shared in any winnings.

ESPN's legal eagle Roger Cossack has said that he suspect that when all is said and done Vick will serve 19 months in prison and one in a halfway house for a total of 20 months.

I also heard Stephen A. Smith going off on one of his rants again, this time against the state case. He thinks that Vick is serving the time, and he shouldn't have to serve state time, too. I would like to point out that if Vick is convicted on the state level, there is no reason to think that they're just going to add time. They could sentence him to a concurrent sentence with time already served - so if he's sentenced to 23 months in prison in say June, he'll have eight already served and serve the remainder at the same time as the federal charges. Now, if he's sentenced to more time than that, he'll have to spend time in a state prison to finish off the sentence.*

Now, with the 23-month sentence, he'll be in prison until through October 2009, so he's as good as out of the NFL until 2010 at the earliest, depending on Roger Goodell's punishment.

So now the question is this: will/when will Mike Vick return to the NFL? What will Goodell's punishment be? If I was Goodell, I'd suspend through the 2009 season and revisit the issue sometime around the draft or minicamps in 2010. Now, will Vick want to come back? Hard to tell. We're not really going to know that until he tells us. If he does return, I don't see many teams signing him (maybe a bottom-of-the-barrel team), and I don't think he's going to be the same player we once knew. I think the Vick that we once knew is gone forever.

You also have to take into the account that Vick will be out of shape when he gets out of Prison. Sure he can work out in prison but probably won't be in NFL form. So when he gets out and wants a come back, he's gonna need to get back in shape...plus...being away from football, he'd probably be a bit rusty in terms of his football skills.

But I think he'll get a second chance and eventually come back. We'll see if he'll be a good player again...or if the NFL even lets him back.

Well, being out of shape is why I don't think he'd be able to come back for any part of 2009 (assuming Goodell were to let him back that soon, which he probably won't). And being rusty at football is what makes me think that few teams will want him. That and, you know, the whole "convict" image he has going on.
