Woman charged with murder in missing body case
Arraignment postponed in case where jeweler hasn't been seen since March 2005 when he failed to return from an appointment.

SANTA ANA – When a door-to-door jewelry salesman went missing in March 2005, Santa Ana detectives looked carefully at Rebeca Diaz-Nivarez after learning that she was the man's last appointment.

When the detectives later found out that Diaz-Nivarez was pawning dozens of items of jewelry at several pawn shops in Santa Ana, they looked even harder.

And after prosecutors say a cooperating witness was able to get Diaz-Nivarez to make some incriminating statements, detectives made an arrest.

Diaz-Nivarez, 43, appeared in Orange County Superior Court today on charges that she participated in the robbery and murder of jeweler Mario Rodriguez Hernandez, 68, on March 18, 2005. Her arraignment was continued to Dec. 21.

Ricardo Dagoberto Diaz-Nivarez, 22, the woman's son, is also charged with murder in connection to the case. But he is believed to be living someplace in Mexico.

It is one of the rare incidents where authorities seek to convict defendants on murder charges in cases where a body was never found.

"It is a misconception that you can't prosecute a murder case without the body," said Senior Deputy District Attorney Larry Yellin, who is handling the prosecution. "What you need is what we call corpus delicti, which means the body of the crime, not the body of the victim."

Not having a body does create some hurdles for the prosecution, Yellin acknowledged, such as giving defense attorneys the opportunity to argue that the victim is still alive – someplace.

"But this doesn't seem to be a situation where Mario ran away or is living the Jimmy Buffett lifestyle someplace," Yellin said. "There has been no activity in his bank accounts, no phone records or any contact whatsoever. There is no evidence that he was alive after March 2005."

Adriana Rodriquez, the victim's granddaughter, agrees.

"He would never have disappeared like that," she said. "He loved his family and he would never have left without telling us."

She said her grandfather sold jewelry door to door out of his van ever since she was a little girl to support his children and grandchildren.

He wasn't a rich man, she said, but he always had a great attitude about life and was very giving.

"If you needed food, clothes or shelter, even if he didn't know you, he would give it to you," the granddaughter said.

Authorities found Rodriguez's van abandoned in Mission Viejo about a week after he disappeared. But they have never found Rodriguez.

Adrianna Rodriguez said she and others in her family lament that they were never able to have a funeral for her grandfather, because his body was never found.

Louie Martinez, the cold-case homicide detective from Santa Ana who is investigating the Mario Rodriguez case, said he hopes to change that.

"We're still trying to find the body," the detective said. "That's something we want to do more than anything else, out of respect for his family. They are good people
