Both victims were from Rochester but only one of the bodies has been found. The feds essentially busted a local drug cartel and two of the people they arrested, including the so-called ring leader, are linked to two Rochester murders. One victim was Ryan Cooper. He was killed in 1999 and his body has never been found. The indictment accuses his cousins, James Kendrick the ring leader and Pablo Plaza. Both men are also accused of killing another man from Rochester, Francisco Santos in 1998. Santos’ body was found in a shallow grave on the Cattaraugus Indian Reservation south of Buffalo. The feds say the murders happened during the course of a drug deal and therefore rising to the level that can include the death penalty. Which is why Pablo Plaza needs an attorney like Bill Easton -- an expert in death penalty defenses. Bill Easton said, “These are very serious charges and it's a very serious penalty. We've seen a lot more of these over the last two years than we've ever seen before. For whatever reason the federal government is pursuing the investigation of these death eligible offenses more than they have in the past in this particular district.” There are a lot of defendants involved. Five are charged in connection with the Francisco Santos murder. They are all facing the possibility of the death penalty. But only Kendrick and Plaza are accused of both. Kendrick will be arraigned on this indictment in about a week or two. He is in jail now on a drug charge. The death penalty is fairly rare especially in New York. If the government gets a conviction, there has not been any indication yet if they will ask for it. The judge made it clear to every defendant that it was a legal possibility. The defense lawyers like Bill Easton are working right now to try to convince the government not to seek it. Easton did say that the U.S. Attorney's Office in western New York have indicted 25 death eligible cases in the last two years. In Easton's experience, that's a lot -- more than anywhere else in the country. |
