The Parties to this Treaty,

Reaffirming their faith in the purposes and principles of the Charter of the United Nations and their desire to live in peace with all peoples and all Governments, and desiring to strengthen the fabric of peace in the Black Sea Area,

Recalling with mutual pride the historic relationship which brought their two peoples together in a common bond of sympathy and mutual ideals to fight side-by-side against imperialist aggression during the Second World War,

Desiring to declare publicly and formally their sense of unity and their common determination to defend themselves against external armed attack, so that no potential aggressor could be under the illusion that either of them stands alone in the Black Seas,

Desiring further to strengthen their present efforts for collective defense for the preservation of peace and security pending the development of a more comprehensive system of regional security in the Black Sea Area,

Agreeing that nothing in this present instrument shall be considered or interpreted as in any way or sense altering or diminishing any existing agreements or understandings between the United States of America and the Republic of Turkey and Ukraine.

Article II

In order more effectively to achieve the objective of this Treaty, the Parties separately and jointly by self-help and mutual aid will maintain and develop their individual and collective capacity to resist armed attack by hostile aggressors.

Article III

The Parties, through their Foreign Ministers or their deputies, will consult together from time to time regarding the implementation of this Treaty and whenever in the opinion of either of them the territorial integrity, political independence or security of either of the Parties is threatened or is victim by armed attack by any nation.

Article IV:

Each Party recognizes that an armed attack in the Black Sea area on either of the Parties would be dangerous to its own peace and safety and declares that it would act to meet the common dangers in accordance with its constitutional processes. Any such armed attack and all measures taken as a result thereof shall be immediately reported to the Security Council of the United Nations. Such measures shall be terminated when the Security Council has taken the measures necessary to restore and maintain international peace and security.

Article V

For the purpose of Article IV, an armed attack on either of the Parties is deemed to include an armed attack on the metropolitan territory of either of the Parties, or the dispatch of special forces or provocateurs or intelligence operatives with intent of disrupting and harming the citizens, infrastructure or government of a signatory country or on its armed forces, public vessels or aircraft in the Black Sea excluding that of the occupied territory of Crimea.

Article VI

This Treaty does not affect and shall not be interpreted as affecting in any way the rights and obligations of the Parties under the Charter of the United Nations or the responsibility of the United Nations for the maintenance of international peace and security.

Article VII

This Treaty shall be ratified by the United States of America and the Republic of Turkey and Ukraine in accordance with their respective constitutional processes and will come into force when instruments of ratification thereof have been exchanged by them at Kyiv (Kiev)

Article VIII

This Treaty shall remain in force for a ten year period upon which a review shall be conducted to determine feasability of extension for another block of ten years time. Either Party may terminate it one month after notice of five years has been given to the other Parties within the agreement.

Article IX

The member nations of this treaty agree to refrain from the manufacture and development of nuclear proliferation in the support of nuclear weapons.

Article X

The treaty shall apply to defensive nature exclusively and shall not be interpreted as enforceable under offensive war. A member signatory must not expect participation from other parties in an offensive war started by a member signatory. Start of an offensive war is defined as an active declaration of war being issued against another nation and offensive actions taken by another nation to undermine the sovereignty of a signatory

Article XI

Treaty obligates the sending of military personnel in response to the attack on a member nation with a large enough and capable enough force of deployed military personnel for the defense of any signatory country. Defense of a signatory country shall be envoked if hostile forces of another country invade or enter the territory of a signatory in a manner that is designated as hostile or illegal by the signatory country. Further can be invoked if a nation send its operatives or intelligence personnel to inflict separatism or attempt to invoke the illegal separation of territories from a member nation and its government. Invocation can also be done if another nation utilizes civilians or intelligence or military personnel to intentionally destabilize a government.

Article XII

Invocation of the treaty shall require a sufficient response of each member nation's armed forces to be deployed in response within 48hours of the invocation occurring. Within 48 hours, an adequate response must be in the process of deploying. Intention of deployment is to be two fold to restore and rescue a member nation and to also ensure that the aggressor country does not have the capabilities by which to attack again.

Article XIII

Ukraine establishes a joint signatory military response and naval facility in the town of Odessa for the signatories of the treaty to station troops, maintain a regional awareness of potential events in the Black Sea region that could destabilize the pact and the relations of its signatories. Further Ukraine establishes that the facility including the construction of an adjacent airfield for air and land coordinated operations shall be provided without cost to signatories so long as the treaty remains in effect.

Article XIV

Signatories establish that treaty signatories shall engage in a minimum of 3 joint military exercises 1 of which must occur in the Black Sea itself in the form of coordinated land, sea and air exercises with two other exercises occurring on land in the territory of one of the signatories replicating a potential event that could lead to the invocation of the treaty. These exercises must have at least 2% minimum of military forces for each signatory participating in the exercises.

Article XV

Signatories establish a rotating pact command that will evaluate existing threats and liason with member nations within the pact itself, the command will be established within Ankara, Turkey with each signatory nation providing liason and military personnel to facilitate the sharing of information and data collections. Signatory nations agree to intelligence sharing on threats that each signatory nation faces within the region and dedicates resource sharing and upgrading of signatory capabilities in this area to understand potential threats and to make pact wide adjustments to avoid military conflict.

Article XVI

Informational sharing shall be done by the intelligence agencies of each nation and shall encompass current threats facing each signatory within the region, in addition regular patrols will be conducted by member nations within the specific areas of the Black Sea with each segment of the Black Sea established as a particular quadrant for patrol and reconaissance to maintain the viability of pact members and their responsive capabilities.

Article XVII

Signatory nations agree to technology and informational sharing as appropriate for the needs and constraints of each signatory, and agree to provide preferential purchase pricing for member signatories and work to upgrade each others defensive capabilities providing military aid where able.

Why are we signing a treaty to give the US more responsibilities globally? We need to work on developing and rebuilding America at home, being required to defend half the world is ridiculous, and will not work.

The US-Turkish-Ukranian Mutual Defense Pact has not passed the United States Senate or the Turkish legislature and is not ratified.
