The Constitution (Ninety Eight Amendment) Act 2012

An Act to further amend the Constitution of India, and specifically abrogate Article 370.

Be it enacted by Parliament in the Sixty Second Year of the Republic, as follows:-

1 ) a) This Act may be called the Constitution (Ninety Eighth Amendment) Act 2012.

b) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.

2 ) In Part XXI of the Constitution, Article 370 shall be removed in it's entirety.

3 ) a) Provisions for the State of Jammu and Kashmir shall be laid out as follows;

b) All Articles under Part VI of the Constitution shall henceforth apply to the state of Jammu and Kashmir.

Honourable members, today is a great day for the Republic. For sixty two years, India has been divided, had been missing one state from it's nationhood, from it's Union. As a former Chief Minister of Gujarat, I have first hand experience of presiding over a state of India, and understand the difficulties of trying to develop a state that has so many ethnic divisions more than most. However, I also know how rewarding it can be, and how integral it is for the Republic that all territories in India are united as states of the nation.

By repealing Article 370, the government will remove the transitional powers that were temporarily granted to Jammu and Kashmir in 1950, and bring them into union with the rest of India. This legislation will be painted as divisive and provocative by the opposition, however is it not divisive to India to grant this state more authority than the rest? It is tome to unify the Republic, and to welcome Jammu and Kashmir into full union with the central government.
