It's not even your genitals though, it's a piece of fabric, same as the rest of your clothing. Yeah they should cut that **** out, but I just don't see how that's something to get emotional about.

And if you're going out of the house in a skirt with no underwear... then you're more likely than not to flash your genitals to unsuspecting strangers anyway, which would make you the perv.

You're trying to put reason into something that isn't reasonable. If that isn't defending then I don't know what is.

I'm not saying the judge wasn't doing his or her, likely his, job. I'm saying he's doing it very poorly, he and everyone involved, yes the entire government of Massachusetts, should feel guilty. Taking a personal picture like that without consent is by no means cool, and honestly the justice system in America is flawed if they are going to allow something as vile as that just fly by due to a clause. The fact that the woman who pressed charges practically got told, "lol ur crotch is his now hahahaha good luck with ur life" is disgusting.

@black lion - it isn't just taking a picture of your genitals, it's taking pictures of that area without consent. which is in turn promoting rape culture. rape culture isn't cute.
And also consider that there would be people perverted enough to take pictures of underage girls and then use the "she looked over 18" defense. The whole law is obscene and degrading.

None of that matters. What matters is there was no consent. The law now pretty much says, take all the pics you want even if she says no. That's why I don't like this law, that's why I'm upset about it.

I don't really see how the idea that a dude (or woman) can walk up to someone else, pull out their camera, and take a snapshot of your crotch, covered up or otherwise, and it being okay. Unless we're gonna head to one of our places and take it a step further...back the **** off. :beard:

Well I'm sure if anyone takes a picture that you happen to be in, and it goes below the waist, your covered crotch is in that picture. In fact everyone is seeing your covered crotch every time you walk outside.

Maybe I'm weird, it just doesn't bother me.

If someone takes a picture and likes what they see, I'm flattered.

If they don't like it, they shouldn't have looked.

My body isn't any more special than anyone else's. I've got all the same parts you do and they probably don't look that much different. I mean, what am I hiding it for? I'm not ashamed of it. My undershorts are clean. :lol:

The woman didn't want the picture taken. If I'm walking by, and I get a picture taken I don't mind. If I find a picture of myself online that I don't like I have the right to ask for it to be taken down. That's how things works. But keep throwing hypotheticals, since that always works.

The fact here is that she didn't want the picture taken, she did not give him consent to take that picture, dude is disgusting and deserves to be treated like trash.

When you say consent doesn't matter, you're saying rape doesn't exist. When you say that since it's covered up it's okie dokie, you're saying consent doesn't matter.

I think you guys are misunderstanding what's going on here.

The law was made in mind to protect people from voyeurs who peep into their houses and take pictures of them in the nude. There were no major or known incidents of this happening before. And thus it was decided that no law was needed to protect against that there- a horrible lack of foresight on legislators' parts. So nothing could be done. Note that three of the justices in the Supreme Court of Massachusetts ARE women. Note that the statement given indicates that the law needs to be changed or that there needs to be a new law protecting

I'm also not saying you can't be upset about the law. I'm pretty upset about there nothing being there myself.

I also think you're misunderstanding my intention here. I would be appalled if it happened to my sister or my mom or any of my friends or any of your guys. I'm appalled it happened at all. I think that there should be a law against it. But judges do /not/ make laws. There was literally nothing they could do to help her that would not break what the law says judges can do. I'm very upset it happened, actually.

I'm also upset here because wanting to enact violence on every employee of a government (which would include other people who feel like us that the law needs to change, in addition to teachers, janitors, and other people who have nothing to do with anything) is just... No. Violence is never okay, except in extenuating circumstances- in this case, self defense or when at war and fighting enemy /soldiers/ (as opposed to citizens of the enemy nation, who should not have harm come to them).

This issue is very close to me as my mother works for the federal government and it hurts me every time someone says a sweeping statement about how "oh all government workers are blah blah blah" because she's a wonderful person.

Edit: And I never said consent doesn't matter. I also never said that this was "okie dokie". But wanting to physically hurt people is also not okay.

That was in response to Black Lion.

I apologize that I came off as violent, I tend to get upset over ignorant ruling like these. I of course would never take my anger off on everyone who is employed by the government, because they are likely people just trying to get by like everyone else. I'll watch my wording next time, and again, I apologize.

I also apologize that it seemed like I was gunning at your mother, I truly did not mean to come off as such.

I don't however understand trying to rationalize this awful case and it's decision. It makes 0 sense.

Sadly, the government doesn't make a lot of sense to anyone except a dedicated lawyer. I'm lucky I understand it at all as it is. As Astus said, it's due for a total reform, which in light of this and other similar events DOES seem needed. At the same time, though, there needs to be a way to make sure whatever changes are made are to the benefit of victims and victims alone, and not of any governmental offices or businesses. It's a very sticky subject, and I normally wouldn't speak up about it, and I only did because I felt people like my mother were being attacked. I realize now that wasn't the intent, and so I say it's alright and thank you.

I apologize if it came off as if I were attacking you or anyone else as well. I also apologize if it seemed at all like I was defending the creep in question. This sort of thing is not okay, and the law really, really needs to be changed or added to to prevent it.
